1. Scope and Provider
1.1 These General Terms and Conditions (Terms) apply to all contracts between Cayan Oyman, Ramsenerstraße 43, 78239 Rielasingen-Worblingen, Germany (hereinafter "PGX") and consumers (§13 BGB / German Civil Code) who order via the website pgxwear.com.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.3 Deviating terms of the customer are not recognized unless PGX expressly agrees to their validity in text form.
2. Subject of the Contract
2.1 PGX sells clothing via pgxwear.com (in particular t-shirts, polos, and tanks) with an individually configurable QR-code print and a customer-selected Aperture variant. Each shirt carries a unique QR code which, upon activation, is linked to an online profile configured by the customer.
2.2 The goods offered are manufactured exclusively after receipt of the order using the print-on-demand process via the production service provider Gelato AS. No inventory production takes place.
3. Formation of Contract
3.1 The presentation of products on pgxwear.com does not constitute a legally binding offer but a non-binding invitation for the customer to submit an order.
3.2 By clicking the button "PROCEED. PAY." (or a button with similar wording) in the final order step, the customer submits a binding offer to conclude a contract.
3.3 Before submitting the order, the customer actively selects the following personalized characteristics:
- Slogan (e.g. "STALKER!", "KNOCK KNOCK.", "SCAN ME, DADDY" — determines shirt type and base color)
- Aperture variant (one selection from ten variants)
- Size
3.4 Before submitting the order, the customer confirms via a mandatory checkbox that the ordered shirt is manufactured according to their individual selections and that the right of withdrawal pursuant to §312g (2) No. 1 BGB is excluded (see Section 8).
3.5 The contract is concluded when PGX accepts the customer's offer by sending an order confirmation via email to the email address provided by the customer. An automated acknowledgment of receipt of the order does not yet constitute acceptance.
3.6 The text of the contract is stored by PGX and sent to the customer by email in the form of the order confirmation. The contract language is German.
4. Prices and Shipping Costs
4.1 All prices are in Euros and include statutory VAT. PGX uses the small-business exemption under §19 UStG (German VAT Act) and does not show VAT separately.
4.2 Shipping costs are listed separately during the order process based on the delivery country and are to be borne by the customer.
4.3 Current shipping costs per delivery country are displayed transparently before the order is submitted.
5. Payment Terms
5.1 Payment processing is carried out by the external service provider Stripe Payments Europe Ltd. (Ireland). Available payment methods include credit card (Visa, Mastercard, American Express), Apple Pay, Google Pay, and SEPA Direct Debit, where offered by Stripe for the delivery country.
5.2 The purchase price is due immediately upon completion of the order process.
5.3 PGX stores no payment data. All payment information is processed exclusively by Stripe.
6. Delivery and Shipping
6.1 Delivery is carried out by the production partner Gelato AS or its shipping service provider. Since Gelato operates local production facilities in over 30 countries, your order is typically produced in the nearest country and shipped from there.
6.2 Typical processing time (production) is 1–3 working days after order receipt. The respective shipping time is added on top:
- Within the EU (incl. Germany): approx. 3–5 working days after production
- United Kingdom, Switzerland: approx. 4–7 working days after production
- USA / Canada: approx. 3–6 working days after production
- Other countries: approx. 5–10 working days after production
6.3 The delivery times stated here are estimates. Binding delivery times for the respective order are displayed during the order process based on the specific product availability and the selected destination country.
6.4 PGX delivers to all countries where Gelato offers shipping. The list of currently supported delivery countries is displayed during the checkout process.
6.5 PGX is not responsible for shipping delays caused by force majeure, supplier bottlenecks, or logistics partners. PGX will inform the customer immediately in such cases.
7. Retention of Title
The delivered goods remain the property of PGX until the purchase price has been paid in full.
8. Right of Withdrawal and Personalization Exclusion
Notice — Right of Withdrawal Excluded
The statutory 14-day right of withdrawal for distance contracts is excluded for the shirts sold on pgxwear.com pursuant to §312g (2) No. 1 BGB (German Civil Code).
Reason: Each PGX shirt is manufactured for the respective customer in a print-on-demand process based on individual customer choices (slogan, Aperture variant, size). Stockpile production or resale to other customers is not possible.
8.1 Before completing the order, the customer expressly confirms via a separate mandatory checkbox that they have acknowledged the exclusion of the right of withdrawal.
8.2 The exclusion of the right of withdrawal does not affect the customer's statutory warranty rights in the event of a defect (see Section 10).
8.3 Independently of the exclusion of the statutory right of withdrawal, PGX grants the customer a voluntary service and exchange policy pursuant to Section 9.
9. Service and Exchange Policy (voluntary)
9.1 In addition to statutory warranty rights, PGX offers the following voluntary assurances to the customer:
9.1.1 Quality Defects (print errors, material defects, wrong item delivered)
In case of print errors, visible material defects, or delivery of a wrong edition, PGX ships a free replacement. Please report the defect within 14 days of receiving the goods at [email protected] with photo evidence.
9.1.2 Wrong Size
If the shirt does not fit, PGX offers a free exchange to a different size within 30 days of receipt, provided that:
- the shirt is unactivated (the QR code has not been used to create a profile),
- the shirt is unworn and undamaged (original packaging, no signs of wear or washing),
- the exchange request is submitted within 30 days of receipt at [email protected].
PGX provides a free return shipping label. After receipt of the return, the desired size is re-produced in the same slogan and Aperture variant and shipped free of charge.
9.1.3 Other Returns (voluntary goodwill)
In individual cases, PGX may accept one other return per customer and credit the purchase price as store credit to the customer's PGX account. Conditions:
- the shirt is unactivated, unworn, and undamaged,
- the return request is made within 14 days of receipt,
- the customer bears the return shipping costs.
The store credit is issued for the full purchase price (excluding shipping costs) and can only be redeemed on pgxwear.com for further orders. A cash payout of the store credit is excluded.
This goodwill arrangement is voluntary and does not establish a legal claim of the customer. PGX reserves the right to adjust or restrict the arrangement in the future.
10. Warranty (Defect Liability)
10.1 The statutory warranty rights (§§434 ff. BGB) for consumers apply.
10.2 The limitation period for warranty claims is two years from delivery of the goods.
10.3 In the case of justified defect complaints, the customer is initially entitled to subsequent performance (delivery of defect-free goods or repair). If subsequent performance fails, the customer has the statutory rights (withdrawal, reduction, damages).
11. Limitation of Liability
11.1 PGX is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.
11.2 In the case of slight negligence regarding a material contractual obligation (cardinal obligation), PGX's liability is limited to the typical, foreseeable damage of the contract.
11.3 Further liability of PGX does not exist. In particular, PGX is not liable for slightly negligent violations of obligations other than those typical of the contract.
11.4 The limitations of liability do not apply in the case of an assumption of a guarantee or for claims under the Product Liability Act.
12. Dispute Resolution
12.1 The European Commission provides a platform for online dispute resolution (ODR) at ec.europa.eu/consumers/odr.
12.2 PGX is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
13. Final Provisions
13.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with their habitual residence in the EU, the mandatory consumer protection provisions of the respective country of residence remain unaffected.
13.2 Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory regulation.
13.3 PGX reserves the right to adjust these Terms if this becomes necessary due to a change in the legal situation or due to changes in the offering. Existing orders are not affected by such changes.
